Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of Lou Minati, a mobile application developed by LumaSeer (“LumaSeer,” “we,” “our,” or “us”).

By creating an account or otherwise using Lou Minati, you agree to be bound by these Terms. If you do not agree, please do not use Lou Minati.

Eligibility

You must be at least 13 years old to use Lou Minati. By using Lou Minati, you represent that you meet this requirement.

Your Account

You’re responsible for maintaining the security of the device and email account (or Google/Apple account) you use to sign in to Lou Minati, and for all activity that happens under your account. Let us know right away at hello@lumaseer.com if you believe your account has been accessed without your permission.

Acceptable Use

You agree not to:

• Use Lou Minati for any unlawful purpose
• Attempt to gain unauthorized access to any account, system, or data
• Interfere with or disrupt the operation or security of the Service
• Reverse-engineer, scrape, or attempt to extract other users’ data
• Use automated tools to abuse or overload the Service

Your Content

You own the commitments, routines, reflections, memories, and messages you create in Lou Minati (“Your Content”). By using the Service, you grant us a limited license to store, process, and transmit Your Content solely as necessary to provide Lou Minati’s features to you — including sending relevant content to our AI provider to generate a response, as described in our Privacy Policy.

You’re responsible for Your Content and for making sure you have the right to share anything you provide to Lou Minati.

AI-Generated Content

Lou’s conversational replies, affirmations, and Morning Brief narration are generated by artificial intelligence. AI-generated content may be inaccurate, incomplete, or out of date.

You’re responsible for evaluating Lou’s output before relying on it, particularly for anything important. Lou Minati is not a substitute for professional medical, legal, financial, or other expert advice.

Service Availability

We may modify, suspend, or discontinue any part of Lou Minati at any time. We don’t guarantee the Service will always be available, uninterrupted, or error-free.

Third-Party Services

Lou Minati relies on third-party services (including Amazon Web Services and Anthropic) to operate. We don’t control these services and aren’t responsible for their availability or performance.

No Warranties

Lou Minati is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, LumaSeer and its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of Lou Minati.

Indemnification

You agree to indemnify and hold LumaSeer harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of Lou Minati.

Termination and Account Deletion

You may delete your account at any time from Settings in the app — see our Support page for details on what deletion does.

We may suspend or terminate your access to Lou Minati if you violate these Terms.

Privacy

Your use of Lou Minati is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Changes to These Terms

We may update these Terms from time to time. Continued use of Lou Minati after changes take effect means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement
